In relation to the management of the PCYC, claims that the Police Commissioner has failed to implement proper governance practices must be addressed.
The PCYC is an incorporated body under NT Legislation and is governed, as a legal entity, by the Executive Committee. The PCYC Constitution empowers the Committee to make decisions for the membership in terms of the business of the incorporated body, and legislation holds the Committee accountable for business activities and financial solvency of this incorporated body. Pursuant to the Constitution the Vice President is currently acting as the President. The Government or Commissioner intervening in the affairs of a duly constituted legal entity poses significant issues. There are appropriate means for resolution of disputes within such bodies in the Acts under which they operate and in their Constitutions.
